Moldova, officially the Republic of Moldova is a landlocked state in Eastern Europe located between Romania to the West and Ukraine to the North, East, and South. The capital city is Chisinau.

Patent

A patent application in Moldova should be filed in Rumanian. If the application is filed in any other foreign language, the applicant must provide the Rumanian translation within 3 months from the date of filing.A copy of the priority application certified by the patent office where this application was filed should be provided to the Moldavian Patent Office within 16 months from the date of priority. The non-legalized Power of Attorney is sufficient. It should be provided simultaneously with filing the application or within 3 months.Substantive examination should be requested and corresponding official fee should be paid within 30 months from the filing date.For the foreigners it is recommended to perform the patent prosecution in Moldova through an agent, a registered Moldavian patent attorney. Besides, it is possible to validate European patents in Moldova since November 1, 2015.

Trademark

As a trademark in Moldova may be registered any graphically represented elements: words, letters, digits, images, color combination, figurative elements, 3-dimentional elements, in particular a shape of a product or its package or any combination thereof. In addition, multiple class application is possible in Moldova.The trademark registration in Moldova is valid for 10 years from the date of filing. Registration may be extended by 10 consecutive years an unlimited number of times. It may be cancelled on the basic of non-use within continuous period of 5 years in case the corresponded request is filed to the court by the interested person.Usually, the opposition against a trademark may be filed within 3 months from the publication of the application.

Industry Design

A protected industrial design in Moldova can be the appearance of a product or its part, in particular created from lines, contours, colors, shapes, texture and/or material of the product and/or its ornaments. The Multiple design application is also possible.A registered industrial design shall be protected for five years from the filing date of the application. The validity of a registration certificate may be extended for several periods of five years each, up to a total of 25 years from the filing date of the application.It is not taken into account the disclosure of information about an industrial design by the author within 12 months from the date of filing of the application, or if priority is claimed from the date of priority.
