Nepal IP Development

Nepal, officially known as the Federal Democratic Republic of Nepal, is a sovereign state located in South Asia. It is endowed with a diverse and rich cultural, artistic and natural heritage and has the unique distinction of being a reservoir of the treasure of traditional knowledge. A real need has been felt within the country for the development of modern intellectual property jurisprudence in order to recognize and protect the intellectual property rights.

Patent

In Nepal, person willing to patent registered in his own name shall have to apply to the Department of Industries with following information including all other evidence:

1. A Power of Attorney duly signed by the Applicant, sealed and attested by two witnesses

2. An Application form duly signed by the Applicant, sealed and attested by two witnesses

3. Name, address and profession of inventor

4. In the case of the invention not invented by the applicant himself, the conditions acquiring such right from inventor by the applicant

5. Method of operation or utilization of such invention

6. Principle or formula, if such patent is based on any principle or formula

7. Drawings and sketch of invention (if necessary)

8. Prescribed application fee as mention in schedule

9. A certified/Notarized copy of the Home or Foreign Registration Certificate along with its Notarized Copy of English Translation.

Trademark

Registration of a Trademark in Nepal is based upon corresponding registration in Home Country or any other country in the World. A duly certified copy of the Home Registration Certificate is required to obtain registration in Nepal. In case if the Home Registration Certificate is not in English language we require a duly verified and notarized English translation of the Home Registration Certificate for obtaining registration in Nepal. Multiple Class Applications cannot be filed in Nepal. Nepal allows the registration of Service Marks. The documents required for filing a new Trademark Application in Nepal include the Power of Attorney signed by the Applicant, sealed and attested by two witnesses, an application form signed by the Applicant, sealed and attested by two witnesses, a certified/Notarized copy of the Home or Foreign Registration Certificate along with its Notarized Copy of English Translation, and 10 copies of prints of the mark (no mandatory for a Word mark).

If the mark is yet to be registered in Home country and applicant wishes to establish date of priority claim the filing receipt of home country must accompany the documents.

Design

Person willing to get registered a design of any goods made or caused to be made by him shall apply to the department along with the following documents:

1. A Power of Attorney duly signed by the Applicant, sealed and attested by two witnesses.

2. An Application form duly signed by the Applicant, sealed and attested by two witnesses.

3. Name of designer: Applicant whether he is the originator or designer or he has received from employer in the course of employment period, should have to mention in application.

4. Description of design along with four copies of such design, maps, drawing & particulars thereof.

5. If the design is yet to be registered in foreign country and applicant wishes to establish date of priority claim the filing receipt of home country must accompany the documents.

6. A certified/Notarized copy of the Home or Foreign Registration Certificate along with its Notarized Copy of English Translation.
