"In 2020, there are seventeen grass-root courts in Beijing used the 'diversification mediation + expedited trial' mechanism to close 324,395 cases, and 21.1% of civil judges resolved 69.5% of civil disputes; the average trial time-length for front-end expedited cases was 49 days, compared with the average back-end trial time has been shortened by 29 days.” On January 13, Beijing Higher People’s Court held a press conference to inform the Beijing Court system of the “diversification mediation + expedited” situation in 2020 and announced the “Top Ten Typical Cases 2020".
At the beginning of 2020, Beijing Higher People's Court sorted out and compiled 25 documents related to the "diversification mediation + expedited mediation" mechanism issued by Beijing Court system in recent years, and formulated 190 articles and 12 appendices of "Beijing Court Civil Cases Diversification mediations + Working Standards for the Expedited Adjudication Mechanism", as a standard document that guides the entire process of sub-adjustment and adjudication, consolidates and deepens the front-end and back-end adjudication pattern, opens up the procedural barriers of diversion, mediation, expedited adjudication, precise review, and realized the organic connection between various procedures.
At the same time, a part of the Courts in Beijing will conduct pilot projects in response to financial disputes. China’s first integrated platform for multiple dispute resolution in financial cases will be launched to improve the protection and relief capabilities of consumers in the banking and insurance sectors; for property disputes, jointly explore the dynamic evaluation of the credit rating of the property company with related administrative departments, urge the property company in the jurisdiction to implement timely rectification and implementation, improve the service level, and reduce the number of property-related cases from the source; for intellectual property disputes, establish "e-copyright" litigation and non-litigation "Online Connection" Mechanism to guide IP-related network infringement disputes to the mediation platform of the Capital Copyright Industry Alliance for mediation; for consumer rights protection disputes, explore the establishment of a "one-stop" judicial confirmation mechanism for administrative mediation agreements to promote the resolution of disputes at the start.
Data shows that "diversification mediations + expedited adjudication" has further demonstrated its role in promoting complicated and simplified cases and promoting the governance of the source of disputes. Coupled with the impact of Covid-19 epidemic and other factors, more than 487,000 civil cases were accepted in Beijing Courts in 2020, a year-on-year decrease of more than 137,000 pieces, a decrease of 22%.
At the press conference, the Beijing Court system also notified the "Top Ten Typical Cases of Diversification Mediation in 2020. It is understood that this is the fourth year that the Beijing Court has carried out this selection, formed a unique brand of Beijing Court. The typical cases demonstrate the effectiveness of the Beijing Court system in resolving disputes at the start and resolving disputes outside of the litigation docking mechanism, as well as strengthening the construction of a one-stop diversification dispute resolution and litigation service system.
