Wuhan Duck Neck Won the “Jingwu” Trademark Dispute

The Trademark Review and Appraisal Board of the State Administration of Industry and Commerce (hereinafter referred to as Trademark Review and Appraisal Board) rejected the application of Jingwu trademark and its logo filed by the Tianjin Jingwu Livestock Breeding Company for the commodities concerning cooked duck neck, cooked duck and cooked duck bill. It meant there was a final result upon the “Jingwu” trademark dispute between Tianjin and Wuhan.
 
It’s learned that Tianjin Jingwu Company mainly runs businesses in the Livestock and marine products raising technology, poultry rearing and freshwater fish farming, provides related consulting services, and so on. In 2005, Tianjin Jingwu Company applied to have “Jinwu” and its logo trademark classified under category 29 and used the trademark on the cooked duck neck commodities.
 
The application was challenged because cooked duck neck has long been a hallmark of the city of Wuhan in Hubei province. At present, the cooked duck neck industry in Hubei province has an annual output value of ten billion Yuan and 10,000 employers. In October of 2007, the Wuhan Jingwu Duck Neck Association was founded and 18 duck neck enterprises on Jingwu Road were absorbed as the first members. Currently the Duck Neck Association has expanded to 110 members.
 
As to the application for the trademark on the “Jingwu” name and its logo, many enterprises filed oppositions, but were rejected by the Trademark Review and Appraisal Board with the verdict that the “reason for the opposition could not stand.” After the reexamination procedure, the Trademark Review and Appraisal Board approved the original oppositon.
