The Expert Symposium on Trademark Law Amending Held

From June 29 to June 30, the Expert Symposium on Trademark Law Amendment was held in Luoyang City in Henan Province. More than 50 intellectual property experts were present and made propositions. Representatives from China’s Legislative Affairs Commission of the Standing Committee of the National People’s Congress, the Supreme People’s Court, the Supreme People’s Procuratorate, Renmin University of China, and China University of Political Science and Law were in attendance.
 
During the Expert Symposium, the attendants discussed in depth the following nine aspects: the relationship between the trademark system in China and the international trademark conventions, the general framework of trademark system in China, the authorization of trademarks, the simplification of procedures, the systems of famous marks and well-known marks, the protection of geographical indications, the trademark agency, the contradictions between corporate names and trademark rights, and judgments and compensation amounts for trademark infringement.
 
The Trademark Law has been revised twice since its formulation in 1983, once in 1993 and again in 2001. Some of the provisions in Trademark Law need adjustments and improvements to meet the challenges brought by rapid economic development. The third revision started in 2003 and the responsible departments, using the basic principle of, “lay down the law in an open and democratic way and spare no efforts to develop the law to international standards,” have solicited opinions from all walks of life through social research and expert symposiums such as this.
