Online registrations of trademarks to account for over 90%

Fu Shuangjian, deputy commissioner of the State Administration for Industry and Commerce of the People's Republic of China (hereinafter referred to as SAIC), expressed on the press conference of "China's Intellectual Property Development in 2010" that the online application for trademarks should be further promoted. By the end of the "Twelfth Five-Year Plan", valid trademark registrations will have reached 8 million, over 90% of which will have been applied for online.

Fu said, "The trademark strategy of SAIC during the period of the 'Twelfth Five-Year Plan' will mainly feature with fully implementing the Outline of the National Intellectual Property Strategy and seriously carrying out the trademark strategy formulated by SAIC so as to improve the registration, implementation, protection and administration of trademarks." The objectives and measures, on one hand, were emphasized on the enforcement of laws; and on the other hand, on the timely formulation of related regulations and policies so as to improve China's trademark legal system.
 
Fu concluded the following five factors upon the long-term goals of trademark strategy.

1.  To create incentive mechanism to promote the continuous growth of trademark registrations. It is to establish both quality and quantity control mechanism for trademark examination so as that relevant departments could complete the trademark examination in 10 months and resolve trademark cases in 18 months  

2. To effectively use and increase the value of trademarks. By implementing the trademark strategy and strengthening the support policy, it is required to make full use of the demonstration cities and model enterprises to enhance enterprises' ability in trademark application, to improve trademark's market value and social value and thus to enhance trademark's visibility and credibility as well as its competitiveness.

3. To safeguard the fair market competition orders. It is mainly to establish the long and effective trademark protection mechanism on a basis of the campaign against the infringements and counterfeiting.

4. To improve trademark standardization and informationization by scientific management. It is mainly to improve the trademark review and standardization by strengthening the construction of trademark registration system; and to further promote online registration so as to make the online registration account for no less than 90%.

5. To strengthen the international registration of trademarks and improve our international competitiveness. It is mainly to greatly encourage enterprises to go out to get registered, to improve China's rating and ranking in the Madrid system, and meanwhile to try to establish overseas IPR protection mechanism and to strengthen the cooperation and communication with other related international countries and organizations with an aim to raise China's international level of trademark.
