IP cases uncovered in Beijing topped in China

In 2011, courts in Beijing totally tried 12,269 IP cases, up 16.3% and accounting for 22.3% of all IP cases nationwide, according to the working paper delivered by President of Beijng Higher People’s Court Chi Qiang at the 5th Session of the 13th Beijing Municipal People’s Congress.

It is introduced that in order to improve the judicial protection of IPR and create an innovation-driven development layout, Beijing Higher People’s Court released Guiding Opinion on the Trial of Internet Copyright Cases and Guiding Opinion on the Trial of Commercial Franchise Contract Cases. Such Opinions not only give guidance on the trial of IP cases but also become the basis for the Supreme People’s Court to stipulate judicial interpretations. Such initiatives attracted the attention of the IP regime and set a good Beijing image in term of IPR protection.

Beijing Haidian District People’s Court is accredited by the Supreme Court to try patent civil cases, which promotes the establishment of Zhongguancun National Indigenous Innovation Demonstration Park. Beijing Chaoyang District People’s Court is selected as the "Demonstration Court in Chinese IPR Judicial Protection". [Chinese version is available on legaldaily.com.cn ]
