A copyright infringement lawsuit filed by a Vancouverite against film director James Cameron was dismissed in Canada's Federal Court Thursday.

After the first day of hearings, Emil Malak, who filed the lawsuit in the Federal Court on Wednesday, dropped the case against Cameron for using his original screenplay in the blockbuster film Avatar which gained global popularity, 20th Century Fox Film said on Thursday.

The company further said that after listening to the evidence presented by Cameron's lawyers, Malak was convinced that Avatar was "independently created" by Cameron.

The Vancouverite initiated the original lawsuit in the Supreme Court of British Columbia, but dropped the case before filing a similar suit in the country's Federal Court on Wednesday.

Malak originally claimed Cameron used content from his 1996 screenplay titled Terra Incognita, which, like Avatar, depicts humans who want to mine precious minerals on a planet inhabited by indigenous people who resist colonization.

The science-fiction epic Avatar was written and directed in 2009 by Cameron, a world-renowned Canadian film producer.
