Youku accused download videos through “UC Browser” for infringement and unfair competition

At present, the operator of Youku, a famous video website in China, accused US Technology Co., Ltd. and another three companies for transforming the videos only available in Youku to the downloadable videos, and claimed that it constituted unfair competition. Youku claimed to order these four companies to make a public apology in writing and make compensations of 5,000,000 yuan for the economic losses. The case is the first unfair competition dispute involving download of videos only available online via browser in China, and is also the first intellectual property case for a Beijing Court issuing an injunction since the implementation of the new Civil Procedure Law of the People’s Republic of China. On the afternoon of April 14th, as four defendants refused to accept the mediation, the judgment of the case was not passed in the court.
