Guess lodged appeals against Gucci logo

2014/05/16

After the lawsuits filed by Gucci against Guess in the U.S. and Italy, the lawsuit was field in Suzhou. By the end of 2013, Nanjing Intermediate People’s Court agreed with the verdict from Miliano and New York that the Quattro G graphic pattern of Guess did not constitute infringement, and Guess should no longer sale the products with G monogram, 8G pattern or the cursive font of Guess.

Guess refused to accept the verdict made by Nangjing Court because the verdict had veered off the relevant regulations of China’s Trademark Law. According to China’s Trademark Law, only if the relevant trademarks can cause confusion in customers, it will constitute infringement. Therefore, Guess had lodged appeals to Jiangsu Higher People’s Court last month and the first hearing was held recently.
