Judicial Protection Plan for Shanghai World Expo Drafted

On the afternoon of May 25, the Bureau of Shanghai World Expo Coordination and the First Intermediate People's Court of Shanghai jointly convened a workshop, negotiating the judicial protection during Shanghai World Expo period.

After investigation and analysis, a set of judicial protection plan was preliminarily formulated. In accordance with the features of the campuses of Shanghai World Expo, the plan required Pudong New Area People's Court to safeguard the intellectual properties of the World Expo, and People's Courts in Luwan and Huangpu located in Puxi area to solve complaints from tourists.

It was analyzed that, two types of disputes will be mostly prone to happen during the Shanghai World Expo. The first type is intellectual property disputes, such as infringements and disputes aroused from marks and audio-visual works of the World Expo, as well as violations of the right of invention of exhibition items and patent-related disputes; and the second is the violation of the rights and interests of tourists.

The Pudong campus of Shanghai World Expo is mainly responsible for tasks at the exhibition places. Therefore, Pudong New Area will focus on the protection of intellectual properties of exhibition items, and set up "World Expo's Litigation Service Center" to conduct special trial of cases involving the World Expo.

The majority of visitors to Shanghai World Expo will go to Puxi area, and shopping behaviors will mostly happen there. For this reason, Luwan People's Court decides to open up a green passage for consumers during the World Expo, carry out online recordation, simplify the procedure of lawsuits and make full use of the trial function of convenience.

Taking the complexity of cases into consideration, the First Intermediate People's Court of Shanghai will set up a special guiding group for cases involving the World Expo, and form a special collegial panel to hear cases with difficulty and of new types, so as to ensure the accurate, fair and efficient justice.
