The beverage product “Nectar” produced by the defendant Donglijian company, and the drink “茶π (Tea Pai )” produce by Nongfu Spring Company are highly similar in their packaging, leading to consumer’s confusion. This constitutes unfair competition against the plaintiff Nongfu Spring and brings its huge economic losses. Jinan Intermediate People’s Court judged that the defendant should immediately stop unfair competition against the plaintiff; and stop to produce, operate and sell beverage with similar packaging decoration like “茶π (Tea Pai )”; and compensate economic losses and reasonable expenditure about 600,000 Yuan to Nongfu Spring.
