Beijing “Daoxiangcun” and Suzhou “Daoxiangcun” Hope to achieve a Win-win Situation by making clear Distinction

Recently, Beijing IP Courts made first instance adjudicate on trademark invalidity administrative proceedings between Suzhou “Daoxiangcun” and Trademark Review and Evaluation Broad of the State Administration for Industry and Commerce (Trademark Review and Evaluation Broad ), rejected the plaintiff’s claim, and sustained the original adjudication that the trademark of Beijing “Daoxiangcun” was valid. Beijing IP Court decided after the trial that the two trademarks had certain approximation, but the co-existence couldn’t cause confusion and misunderstanding among consumers, that’s why the disputed trademark didn’t infringe the profit of Suzhou “Daoxiangcun”. And the court also pointed out that Suzhou “Daoxiangcun” and Beijing “Daoxiangcun” had played a positive role in the development and continuation of the commercial reputation of “Daoxiangcun.”
