Beijing TV Station Is Adjudicated Infringement For A Documentary Great Western Hills

Recently, Beijing Haidian Peoples Court (Haidian Court) delivered the first instance adjudication on the infringement allegation of Mr.Wang against Beijing TV Station, ruling that the station stops infringement, and pay a cost of 100 thousand Yuan. Satisfied with the decision , Beijing TV Station has made an appeal. Mr. Wang claimed that he had painted and owned the copyright of four paintings which involves in this case, and they were shown in two frames and were dynamically processed in episode 4 of the documentary Great Western Hills without authorization, violating the rights of authorship , revision, integrity, production, and communication through information network. And Beijing TV Station argued that the Great Western Hills was authorized to a third party to produce, and they did fulfill their obligations under the contract. Meanwhile, the documentary had nonprofit nature, and it was to illustrate the rebellion of An Lushan and Shi Siming of Tang Dynasty to have a fair use of the paintings involved, not constituting infringement. Haidian Court rejected the defendant argument and adjudicated that Beijing TV Station infringed Mr. Wangs rights.
