National-level branding: 2,473 geographical indication products generated!
国家知识产权局:截至3月底我国累计批准地理标志产品2473个

China is putting relentless efforts to build brand identities for the constellation of specialty products of Chinese origin, targeting consumers at home and abroad. The China National Intellectual Property Administration (CNIPA) has recently revealed that as of the end of March 2021, 2,473 geographical indication products have been approved, and 6,209 geographical indications have been registered as collective or certification marks. For example, the geographic indication of Xili Tribute Rice was approved for the high-quality rice produced in Rongjiang County, Guizhou Province, China.

In the first quarter of 2021, the CNIPA newly approved 99 geographical indication products (including 96 mutual recognition and guarantee geographical indication products) and 124 geographical indications registered as collective trademarks and certification marks. The CNIPA also approved the applications of geographical indications of 1,461 enterprises, seeing a year-on-year growth rate of 669%.

In 2020, the CNIPA issued the "Measures for the Administration of the Use of Special Marks for Geographical Indications (for Trial Implementation)". The act aimed at facilitating the protection of geographical indications. In 2020, the revenue of the enterprises generated by using geographical indications on their products reached about 10 billion USD.

中国正在持续建立面向国内外消费者的中国产品的品牌形象。中国国家知识产权局(CNIPA)近期透露,截至2021年3月,已批准了2,473种地理标志产品,并注册了6,209种地理标志作为集体商标或证明商标。 例如,锡利贡米的地理标志已获准用于中国贵州省榕江县生产的优质大米。

据悉,国家知识产权局2020年印发《地理标志专用标志使用管理办法(试行)》,推进地理标志统一认定,加强地理标志及专用标志使用企业协同监管,同时大幅压缩专用标志使用核准时间,地理标志保护水平显著提升。2020年使用地理标志专用标志企业直接产值总计6398亿元。

Annual parade: 22nd WIPO-CNIPA awards announced!
第二十二届中国专利奖评审结果公示

The complete list of the Winners of the 22nd WIPO-CNIPA Award for Chinese Outstanding Patented Invention was announced to domestic media to solicit public opinions by the China National Intellectual Property Administration (CNIPA) on May 10, 2021. Given annually by the CNIPA in association with the World Intellectual Property Office (WIPO), the awards are a national top recognition of excellence in the innovations and promotions achieved in China’s IP system.

30 Gold Medals, 60 Silver Medals, and 826 Merit Medals were awarded for innovations. 10 Gold Medals, 15 Silver Medals, and 56 Honorable Mentions were awarded for industrial designs. The window of time available for the submission of public opinions was set to be May 10 to 14, 2021. Any questions and suggestions could be delivered to the administrative office of the Award in written form.

Domestic institutions of higher learning have been obtaining steadily stronger presence in the field of innovations, in the capacity of standalone inventors or first inventors. 5 Golds, 8 Silvers, and 70 Honorable Mentions were secured under their belts at the 22nd Award.

The Award ceremony will be held in China’s Dalian city.

5月10日,国家知识产权局官网发布《第二十二届中国专利奖评审结果公示》。该奖项由CNIPA每年与世界知识产权局(WIPO)联合颁发,是对中国知识产权事业所取得的创新和推广方面卓越表现的国内最高奖励。

本届共评选出中国专利金奖预获奖项目30项,中国外观设计金奖预获奖项目10项,中国专利银奖预获奖项目60项,中国外观设计银奖预获奖项目15项,中国专利优秀奖预获奖项目826项,中国外观设计优秀奖预获奖项目56项,现予以公示,公示期为2021年5月10日至5月14日。

据统计,高校作为独立完成单位或第一完成单位,在本届拟获奖项目数为83项,成绩极为亮眼。 其中,高校拟获中国专利金奖预获奖项目5项,中国专利银奖预获奖项目8项,中国专利优秀奖预获奖项目70项。

第二十二届中国专利奖颁奖典礼将会在中国辽宁大连举行。

China is leading the world of 6G patents, briefly?

In late April, the China National Intellectual Property Administration released a “6G Communications Technology Patent Development Report”, identifying more than 38,000 rights applications thought to be relevant to the next generation of wireless standards. The headline finding is that 35% of the cited patents come from China. That represents a lead over the United States, which is the next biggest source of possible 6G patents with 18% of the total.

Despite all, the top five entities identified as holding 6G-relevant rights are all from Japan and South Korea. The leaders of the pack so far: NEC, Daewoo Communications, Mitsubishi Electric, ETRI, and Samsung. Huawei and ZTE don’t figure in the top 10, while Chengdu city-based University of Electronic Science and Technology of China made it onto the list.

It is also noteworthy that 80% of the 6G telecommunications patents applications in China were conducted by domestic entities, of which the top 10 are Chinese universities and research institutes.

Goodbye, LEDs: LG Innotek to sell out LED patents and equipment to Chinese firm

LG InnoTek, a subsidiary of LG Corporation devoted to electronic components, will sell its patents and equipment related to its LED business to a Chinese LED company, according to The Elec, a local media outlet. The South Korean component maker will clean out equipment related to LED at its Paju plant within the month, people familiar with the matter said. LG InnoTek will hand over some 10,000 patents related to LED to its Chinese counterpart. Besides the payment, this will allow the Korean firm to save around 1 billion won in maintaining those patents. Last year, LG began talks to sell its LED patents and equipment for 100 billion won in turn-key fashion. The Chinese company will be able to make a profit from the LED business, and the secured patents will also allow it to defend itself from potential lawsuits filed by rivals. LG InnoTek has invested largely in its LED business before selling it, especially in ultraviolet (UV) LED areas. The deal to sell the business likely went through because of the high-value patents related to UV LED. Some have voiced concern over the selling of UV LED patents as they believed LG InnoTek could license them instead. The South Korea component maker decided to exit the LED business in October, 2019. In the second quarter of 2020, it attempted to sell its LED facilities in China and South Korea, but these talks were delayed due to the COVID-19 pandemic.

Huawei’s Q1 patent licensing income overtakes Nokia and Ericsson

According to the Q1 earnings results announced by Huawei in late April, its patent royalty figures, which has not previously reported quarterly licensing revenues, has reached $600 million. It suggests that Huawei earned more from patents than either Nokia or Ericsson in the first three months of 2021. Ericsson’s patent licensing revenue in the quarter was reported to be $96 million.

Tailing Huawei: OPPO also became HEVC Advance licensor

On May 6, 2021, OPPO, a Chinese smart device company with increasing global presence, announced that it had become a licensor of the HEVC Advance Patent Pool. With this addition, OPPO’s HEVC/H.265 standard essential patents were included in the HEVC Advance patent portfolio license, which now totals over 13,700 worldwide patents and counting. Last January, another Chinese smart device maker Huawei was inducted by HEVC Advance as its patent pool’s licensor and licensee.

In October 2019, OPPO participated in the Media Coding Industry Forum (MC-IF) as one of the organization’s members, which include Intel, Ericsson, Tencent, etc. At the forum, OPPO revealed that it had been growing its patent portfolio of VVC/H.266 technology, a perfect companion to 5G.

As of March 2021, OPPO has filed for 61,000-plus patents as and granted 26,000-plus licenses worldwide. Beyond its constant focus on video codec technologies, OPPO has been striving to build a strong pool of patents to 5G telecommunications standards in over 20 countries and regions worldwide. And it has even filed for 2,450 AI patents.

The IP in Fonts and typefaces matters, dearly

China is witnessing the amount of lawsuits to have spiked 100 times over the infringement of the IP in font and typeface designs over a decade, The Beijing News has learned. The damages per infringement in suits filed against e-commerce shop owners have averaged 800 USD.

The case where Founder Group, a Chinese technology conglomerate, sued Blizzard Entertainment, a US game giant, over the fonts of Chinese calligraphy, asking for damages of about 40 million USD, massively raised the awareness of the IP in the font and typeface designs in China 14 years ago.

Upon the characters “字体 著作权” (“font copyright” in Chinese) being typed into the search engine on the Qichacha website, 352 cases of copyright infringement of font and typeface designs will be presented as results pages to function as risk warnings against the enterprises involved in these cases as defendants. So far, there have been 34 actions filed in 2021.
