秘鲁知识产权概况

  秘鲁是世界知识产权组织和大多数主要国际知识产权保护协议的成员国(包括《伯尔尼保护文学和艺术作品公约》、《保护工业产权巴黎公约》、《世界版权公约》和《罗马公约》)。2009年3月6日秘鲁向WIPO提交《专利合作条约》(PCT) 加入书,成为该条约的第141个缔约国。该条约于2009年6月6日对秘鲁生效。

  秘鲁现在还未能对知识产权提供充分、有效的保护。在知识产权保护上,虽然秘鲁近几年来取得了相当大的进步,但是仍然落后于国际标准。

  最近几年,知识产权专利商标版权)的合法权利人在权利保护上越来越成功。根据秘鲁当前的法律框架,商标专利的注册很方便。不过,商标、图书、磁带、软件和音像制品的假冒仍然很普遍。尽管存在司法和执行机构,但是许多人认为,秘鲁的司法和执行机构仍然有待改进。

专利商标

  1996年秘鲁制定了《工业产权法》,为专利规定了有效保护期,同时禁止卫星信号解码设备以及其他改进装置。秘鲁法律并没有规定专利的连带保护,也没有规定对同类产品进口作出限制。

  秘鲁已经加入世界贸易组织和世界知识产权组织,此外也是许多世界知识产权组织的签约国。

  根据秘鲁的法律框架,商标注册比较容易,并且从1994年起,发明人可以申请发明专利。尽管秘鲁法律规定了有效的商标保护,但是仿冒商标版权产品,以及进口盗版商品的行为仍然很普遍。

  在秘鲁,申请注册商标的整个过程需要8到12个月。商标一经注册,其有效期应当从提交申请之日起10年内有效,到期后可以续展。

版权

  秘鲁的版权法整体上与TRIPs协议一致。不过,教科书、技术图书、录音磁带、电影录像和软件等普遍存在盗版现象。在过去数年间,秘鲁政府通过与私营部门配合,对大型分销商和盗版产品的用户进行了多次突击检查,同时也加强了其他方面的执法力度。秘鲁政府于2004年7月将侵权行为的最低处罚提高至四年监禁,2006年11月,秘鲁政府宣布将由首都利马的四个特别一审法庭和一个特别上诉法庭负责审理知识产权案件,本规定于2007年生效。这是秘鲁司法上的一个重大突破。

  秘鲁驻外大使馆和利马商务部的网站提供有知识产权工具箱。工具箱中提供知识产权注册和保护指南,此外还包括一份律师名单,以及一份可以提供连续性服务的支持组织名录。

  Peru is a member of the World Intellectual Property Organization (WIPO) and a party to most major international intellectual property protection agreements (including the Berne Convention for the Protection of Literary and Artistic Works, the Paris Convention for the Protection of Industrial Property, the Universal Copyright Convention, and the Treaty of Rome on Neighboring Rights). Peru submitted "Patent Cooperation Treaty" (PCT) to the WIPO on March 6, 2009 and became the 141th Treaty parties. The treaty became effective to Peru on June 6, 2009.

  Peru does not yet provide adequate and effective protection of intellectual property rights; although protection of intellectual property in Peru has improved significantly in recent years, it still falls short of international standards.

  Legitimate owners of intellectual property rights (patents, trademarks, and copyrights) have had increasing success in protecting their rights in the past few years. Peru's legal framework provides easy registration of trademarks and patents. Still, counterfeiting of trademarks, books, cassettes, software, and videos is a widespread phenomenon.

  An enforcement and judicial branch do exist, but many believe that it could be improved.

Patent and Trademark

  Peru's 1996 Industrial Property Rights Law provides an effective term of protection for patents and prohibits devices that decode encrypted satellite signals, along with other improvements. Peruvian law does not provide for pipeline protection for patents or protection from parallel imports. Peru belongs to the World Trade Organization (WTO) and the WIPO. It is also a signatory to many world intellectual property organizations.

  Peru's legal framework provides easy registration of trademarks, and inventors have been able to patent their inventions since 1994. Although Peruvian law provides effective trademark protection, counterfeiting of trademarks, copyrighted products, and imports of pirated merchandise are widespread.

  The processing of an application for registration takes between 8 and 12 months in Peru. Once the trademark has been registered it is effective from the date of filing and will remain in force for a period of ten years and renewable thereafter.

Copyright

  Peru's Copyright Law is generally consistent with the TRIPs Agreement. However, textbooks, books on technical subjects, audiocassettes, motion picture videos and software are widely pirated. While the government, in coordination with the private sector, has conducted numerous raids over the last few years on large-scale distributors and users of pirated goods, and has increased other types of enforcement. The Peruvian government in July 2004 increased the minimum penalty for piracy to four years imprisonment. In a major breakthrough, in November 2006, four special courts of first instance and one special appeals court in Lima were assigned IPR duties, effective in 2007.

  An IPR Toolkit for Peru can be found on the Embassy and Commercial Service Lima's websites. Besides being a guide to registering and protecting IP, it contains a list of lawyers and other organizations that can provide support on an on-going basis.
