Changes in Design Application in Republic of Korea

Effective from January 1, 2010, a design application practice has changed in a more convenient way for an applicant. The main changes are as below:

i) 3-D image file allowable
When submitting the drawings in an electronic file, a 3-D program file is also acceptable. The change especially removes difficulties for an applicant who previously had to submit a two-dimensional image file for a 3-dimensional image design.

ii) No limit to style and number of drawings
A perspective view and six drawings with orthographic projection are no longer necessary when filing a design application. Under the changed practice, there is no limit to drawing styles and even the submission of a single drawing would be sufficient if the contents of the design and the entire shape to be registered are clearly specified in such a single drawing.

iii) Expansion of the subject articles for unexamined design registration
The subject articles for unexamined design registration have been expanded from 6 classifications to 10 classifications adding footwear and offices supplies. Such changes may contribute to a prompt acquirement of a design right and more effective enforcement for a design having a short life cycle.

iv) Expansion of number of designs for one set of article
There has also been an expansion of number of designs for one set of articles from 31 to 86 sets, including a shaving kit and a swimming suit set, whereby the designs of one set of articles may be filed in a single application if the designs have a common concept or design.
