Appeals Court Won't Lift Injunction on Galaxy Tab Sales

U.S. District Judge Lucy Koh in San Jose, Calif., issued the injunction last month after finding Apple had made a strong case that Samsung violated its design patent. The patent describes the front, back and sides of a device that looks similar to Apple's iPad tablet computer.

The preliminary injunction bars Samsung from making or selling the tablet computer, or any similar device, in the U.S.

In a short written order Thursday, the U.S. Court of Appeals for the Federal Circuit rejected Samsung's request for a stay of the injunction while the company's appeal is pending. The court didn't explain its reasoning in detail, but said Samsung hadn't demonstrated that the stay should be granted.

In a second order, the appeals court rejected Samsung's request to expedite consideration of its appeal.

An Apple spokeswoman reiterated the company's previous comment that it is committed to protecting its intellectual property.

A Samsung spokesman said the company would continue to pursue its appeal.
